Board of Appeals approves setback variance for 110 Country Club Road

Board of Appeals · Meeting of April 28, 2026

Sandwich Board of Appeals approves variance for noncompliant residential setback. The Board unanimously granted relief to a homeowner at 110 Country Club Road after the home was built in violation of the town's 59.4-foot front yard setback requirement. The applicant's attorney argued the violation stemmed from elevation and lot-shape issues rather than a discrete setback problem, and that miscommunication of a town notice contributed to the noncompliance.

Builder Philip Miller stated he had believed the project conformed based on measurements from the lot's center and never received a critical notification from town officials. The Board also upheld the Building Commissioner's appeal decision on the same property, clearing the way for occupancy. ===BRIEF===
